「訴訟をさけるには」
…toの所が表しているのは、条件というよりは逆に「目的」てすね。
(「〜するためには」という話に近いです。)
その「ため」の条件を述べる文で使われることもありますが、不定詞自体が条件を表しているかというと、どうかなと思います。
